Abstract

This paper analyzes in detail the argument of Robert Alexy, in virtue of which the subsumption is not rational, since there is a method that is more, as is the balancing. The working hypothesis is that an imprecise description of the subsumption allows the debate on the rationality of the balancing to be ambitious and, at the end, to declare the debate in its favor resolved. This incorrect description, plus the misunderstanding of Jerzy Wróblewski’s notions of internal justification and external justification and misplacing Jürgen Habermas as a “critic of the formula of balancing,” will generate the impression of solving the problem of rationality of this method of application of principles.
