Résumé

This doctoral dissertation deals with a topic which is original by two main reasons. On the one side, it addresses banking employment and labor law from the viewpoint of a labor relations manager. On the other side, it is framed in a comparative legal analysis of banking labor relations. It is structured in three Chapters, on the basis that the key tool to manage labor relations is apparently the collective bargaining agreement. The first Chapter studies the two main models for managing labor relations in the banking industry, that is, the Continental European model and the American one. The second Chapter deals with the American model, focusing it in the case (using this term not in its langdellian sense, but in the sense usual in business administration schools) of JP Morgan Chase & Co. bank (the largest American private bank), in which labor relations are managed using a mass individual arbitration agreement, because this bank is not covered for any collective agreement. The third Chapter analyses the Spanish model for managing banking labor relation, as a variant of the Continental European one, in which the main legal tool to manage them is the XXIIIrd collective bargaining agreement for private banking industry.
