Aproximación al elemento transfronterizo intrínseco en las relaciones contractuales derivadas de la economía colaborativa

Abstract

The purpose of Regulation (EU) 2019/1150 is to protect professional users of online intermediation platforms, as the general and specific conditions that bind the parties involved are often imposed. Thus, the European legislator has acted with the aim of ensuring that such platforms bring their commercial practices into line with good faith and contractual fairness. From an international private law perspective, the most relevant developments in the contractual sphere in relation to the collaborative market are analysed, both theoretically and from a jurisprudential perspective, in terms of international jurisdiction.
