Résumé

In accordance with articles 18.3 and 55.2 of the Constitution, and under the jurisprudence of the Constitutional Court, the Court of Justice of the European Union and the European Court of Human Rights, the authorization from the relevant judicial authority articulates the procedural guarantees against interception of telecommunications through advanced technological tools for a criminal investigation. This telephone tapping and other interventions of content and traffic data must be subject to the principles of specialty, suitability, exceptionality, necessity and proportionality, insofar as they limit the fundamental rights to secrecy of communications and protection of personal data. For which it is inexcusable to requere the specific grounds for the judicial authorization, from a procedural perspective derived from the right to a fair trial and the right to an effective remedy.
