Abstract

Decision T-406 of 5th June, 1992, is the beginning of the constitutional jurisdiction in Colombia. This decision founded the bases of the jurisprudence of the Constitutional Court on transcendent issues such as the concept of the social rule of law, the identification and content of fundamental rights, the typology of constitutional norms, constitutional interpretation, the role of the judge and the legislator in the new model of State and the enforceability of rights of social content. This work, under the pretext of the analysis of the sentence, reviews the implications that certain theoretical constructs, such as jurisprudence of values ​​and Alexy’s theory of principles, have on jurisdiction and constitutional interpretation. The conceptual definitions of this sentence have become doctrinal topics, so its analysis is equivalent to observing in practice the concepts that guide the current constitutional justice in Colombia.
