Abstract

The international society constantly shows us that the struggle between the protection of human rights and States'  foreign actions is always latent. This struggle also affects the realm involved in the international fight against impunity in such few cases where political pragmatism has become part of a criminal process. Evidently, the quest for international responsibility is still a rare exception, as only a limited number of cases reach the courts, given that there are countless obstacles before justice can be served when it comes to securing a State’s national interests and safety. In the face of this scenario in which there has been a setback in the procedural guarantees affecting human rights and international standards, we take advantage of today’s context to revive an old debate revolving around the following question: To what extent does a State’s foreign policy condition the prosecution of international crimes? This seemingly rhetorical question directly challenges the pillars on which our system traditionally rests, though, and it is precisely there where the true debate lies.
