Résumé
The European Convention for the Protection of Human Rights and Fundamental Freedoms (ECHR) provides for the right to privacy as a fundamental right in Article 8. The European Court of Human Rights (ECtHR) has developed the traditional right to privacy in its case law, transforming it into a fundamental right that encompasses a wide range of freedoms. This paper examines the Strasbourg Court's use of the tests of reasonable expectation of privacy, necessity in a democratic society and proportionality. The Strasbourg Court uses these to determine whether an interference with a person's right to privacy is permissible. For a practical examination, the recent Bărbulescu and López Ribalda cases will be analysed in particular.
