Abstract

Social networks have substantially modified the way in which citizens communicate with each other, while also presenting a notable influence in the framework of labour relations. The sentence under analysis deals with the dismissal of a worker who, through the social network “Facebook”, shows their agreement, through the “like” button, of certain comments published therein. Faced with such an action, their employer decides to fire them for disturbing the social peace in the workplace. The European Court of Human Rights is in charge of analysing whether their activity falls within the scope of their freedom of expression or, on the contrary, exceeds the limits of this fundamental prerogative and, therefore, the contractual termination of the worker is legitimate and objectively reasonable.
