Zusammenfassung

Although the Spanish legal system provides for the protection of female workers who are victims of gender violence (understood according to the concept of Organic Law 1/2004, of 28 December) against dismissal by the employer based on their personal situation, judicial reality shows that there are still judgments in which this wish of the legislator does not seem to be put into practice with guarantees. The STSJ Comunidad Valenciana 21 April 2021 (rec. 3186/2020) has to deal with one of them, in facts that have the peculiar element that the aggressor is precisely the employer of the female victim worker.
