Zusammenfassung
The defense of the Constitution in the 21st century is synonymous with the protection of the democratic rule of law. The space-temporal coordinates in which the Constitution was conceived, as an abstract organizational reference point in the hand of the French Revolution and as a key element for Spanish democratization, have changed suddenly in recent years, and particularly in the last Legislature. In the reflection carried out here, we will start by analyzing three categories of concepts: globalization, populism and constitutionalism, in order to lay the foundations of a prospective analysis, anchored in factual references to assumptions that we can classify as populist. In the last stage of this essay we will articulate the strategies to which Constitutional Law can resort to counteract and anticipate populist deviations. The role of the Constitutional Courts and their reaction to the currents that advocate a weak judicial review will be the key.
