Resum

A few months ago, the media insistently published news about the increase in illegal building occupancy in Spain and the ineffectiveness of the regulations in this regard. This caused the presentation of several Law Proposals by conservative Parliamentary Groups and that the Executive react by dictating the Instructions of the State Attorney General's Office and the Secretary of State for Security. The following paper deals, very briefly, with the veracity of that information and the sufficiency of the protective regulation of building property, with special reference to the criminal Law (specifically to the crimes of forced entry and usurpation/squatting), from whose perspective the constitutional rights at stake will be seen: the right to privacy and inviolability of the home, the right to private property and the right to decent and adequate housing
