Abstract

Homophobic public statements may constitute discrimination in respect of employment and occupation when they come from a person who has a determining influence on the employer's recruitment policy, as long as they're not simply hypothetical. In fact, a national legal system (in this case the Italian one) may consider that a professional association is entitled to institute legal proceedings to seek compensation for damages in the LGTBI collective, even if no directly injured person can be identified.
