Résumé

Family law has been left without a defined object, because the law does not comprise a unitary and coherent concept of the family, but regulates situations highly heterogeneous and pays preferential attention to the economic obligations arising from these different situations and relationships. Thus, the basis of the legal notion of family (and especially marriage) is no longer a constitutive formality or affection or sexual exchange coexistence or a biological link (as regards +liation). Consecutively, the only aspect that is being left of family duties is the effective legal support for those cases which are not of an economic nature. But the civil dogma is still tied to the naturalistic and past conception of family.
