Résumé

The disciplinary regime of the University student is a thorny issue and, nevertheless, absolutely peremptory if we wish to advance in the path of modernization of our Universities. The Organic Law of Universities of 2001 has not even established minimum basic red lines on applicable infractions or sanctions. While waiting for a general rule in this regard, some Universities have chosen to pass and apply their own internal sanctioning regulations, seeking to guide academic discipline and coexistence in the respective institution. Their value is, in any case, more than doubtful both from the formal perspective, if not also the material one, of the legality principle that is recognized to this effect in article 25.1 of the Spanish Constitution.
