Abstract
After the parents' breakup, it is a matter of enabling the maintenance of the status that their children enjoyed during their normal coexistence. The work, based on this principle of departure on which it is possible to affirm there is a consensus, analyzes how it has been interpreted by the jurisprudence of the last years, completely disregarding the tenor of art. 146 CC.
