Resumo

The Spanish Single Market Act 20/2013, passed on December 9, aims to remove all insurmountable obstacles to such unity, notwithstanding the unavoidable legal diversity originating from Spain�s Autonomies. In such sense, its article 26 bears new administrative proceedings as a means to swiftly eliminate any single market barriers detected by economic operators. The determination of its scope attracts special attention, both from the perspective of the dissociation of the power to process and decide the proceedings, as well as from the specific point of view of the individuals with the capacity to bring such proceedings. It is not, in any case, an inconsequential matter, considering not only the casuistry involved in the definition of the rights and faculties attached to the aforesaid principle, but the legal fineness necessary to delimit and specify there where the Constitution and the lawmaker may seem, sometimes, indecisive and indefinite.
