Abstract

The objective of this thesis is to address the elements of patrimonial damage to the State caused by public servants in the exercise of their functions. It analyzes the susceptible subject of the action of responsibility, the degree or type of responsibility, the exhonerantes of responsibility, as well as the typification and fulfillment of the legality requirements of the event susceptible of the patrimonial damage. Finally, the importance of the care of the public heritage for the fulfillment of the public policies and financial sustainability of the country will be analyzed.
