Abstract

Whether in its common modality, contained in article 49 of Penal Code, or in the variant aimed at minors or in those included in municipal ordinances as a measure to replace pecuniary sanctions, community service work shares the characteristic of constituting an excluded employment relationships from those contemplated in article 1.3 of Worker’s Statute. Despite this legal decision, there are constant echoes of labour institutes in its legal organization, in particular as regards the application of non-specific employment rights, the regulation of working time and the feasibility of flexible formulas for its articulation, or serious and culpable conducts that may give rise to incidents. The important of social legislation is even more obvious when there is an express reference to the prevention of and protection against occupational hazards.
